CONSENT TO TERMS & CONDITIONS
By using the services of Branch Out Travel Group LLC, making a reservation, submitting payment, or accepting a travel proposal or invoice, you acknowledge that you have read, understand, and agree to these Terms & Conditions.
You authorize Branch Out Travel Group LLC to act on your behalf in arranging and facilitating the travel services you request.
You confirm that you are at least 18 years of age and have the legal authority to enter into this agreement and make travel arrangements for yourself and/or any travelers included in your reservation.
If you are making arrangements on behalf of other travelers, you are responsible for making sure they are aware of all applicable trip information, requirements, policies, and Terms & Conditions.
If you do not agree with these Terms & Conditions, please do not use the services of Branch Out Travel Group LLC or submit payment toward a reservation.
CONCIERGE CARE FEE & REVISIONS
For custom travel planning, consultations, research, or professional travel guidance, a $78 nonrefundable Concierge Care Fee may be required. This fee covers the professional time, expertise, research, and guidance Branch Out Travel Group LLC provides based on your individual travel needs.
The specific services provided will depend on the type of travel assistance requested.
Hosted Group Trips: The $78 Concierge Care Fee does not apply when booking one of Branch Out Travel Group LLC’s pre-planned hosted group trips unless otherwise stated.
Changes & Revisions: Concierge Care includes up to 3 total changes to your proposed resort, hotel, or destination. Additional changes beyond the three included may require an additional fee.
The Concierge Care Fee is separate from any deposits, payments, or fees required by hotels, resorts, cruise lines, tour operators, airlines, or other travel suppliers.
PACKAGES, SUPPLIERS & PRICING
Branch Out Travel Group LLC works with independent travel suppliers, including hotels, resorts, cruise lines, airlines, tour operators, transportation companies, and activity providers. Each supplier has its own terms, conditions, cancellation policies, and requirements that also apply to your reservation.
Pricing & Availability: Prices and availability are subject to change until the required deposit or payment has been made and your reservation is confirmed.
Once confirmed, your reservation remains subject to the supplier’s terms and conditions. Any supplier-imposed increases in taxes, fees, surcharges, or other charges are the traveler’s responsibility.
Branch Out Travel Group LLC is not responsible for pricing errors, incorrect information, or changes made by a supplier. If a supplier identifies a pricing or booking error, the supplier’s policies will determine whether the reservation can be honored or must be adjusted.
Unless specifically listed as included in your package, personal expenses, meals, beverages, baggage fees, insurance, passport or visa fees, excursions, and other incidental expenses are not included.
BOOKING ACCURACY & LEGAL NAMES
It is the traveler’s responsibility to carefully review all booking information as soon as it is received, including names, dates of birth, travel dates, airports, accommodations, activities, and pricing.
Your first and last name must match your government-issued identification or passport exactly as required by the travel supplier.
Please notify Branch Out Travel Group LLC immediately if you notice an error or omission. Any fees, penalties, or additional costs resulting from incorrect information provided by the traveler or failure to report an error are the traveler’s responsibility.
Once a reservation is confirmed, corrections or changes may also be subject to supplier fees and restrictions.
TRAVEL DOCUMENTS & ENTRY REQUIREMENTS
Each traveler is responsible for having the proper identification and travel documents required for their trip, including passports, visas, REAL ID-compliant identification when required, birth certificates, travel authorizations, or other documents required by the destination or travel supplier.
Travelers are responsible for verifying all entry, exit, passport, visa, health, and documentation requirements for every destination they will visit or travel through.
For international travel, some destinations require passports to remain valid for a specific period beyond the travel dates. Travelers should verify the requirements for their destination well before departure. https://www.tsa.gov.
INDIVIDUAL ENTRY & EXIT REQUIREMENTS
Criminal Records: Each country has its own entry and exit requirements regarding current or past criminal offenses. A criminal record may affect your ability to enter or travel through certain countries. If you have a current or past criminal offense, it is your responsibility to determine whether it may affect your travel eligibility and to verify the requirements directly with the appropriate government authorities before booking or traveling.
Other Travel Eligibility: Other personal or legal circumstances may also affect your ability to obtain required travel documents, board transportation, or enter or exit a destination. It is each traveler’s responsibility to determine their eligibility to travel and resolve any restrictions before departure.
Branch Out Travel Group LLC does not determine a traveler’s eligibility to enter or exit a destination and is not responsible for denied boarding, denied entry, missed travel, cancellations, penalties, or additional expenses resulting from a traveler’s failure to meet applicable entry, exit, or documentation requirements.

CHILDREN & MINORS
Travelers under age 18 must travel with an eligible adult as required by the applicable travel supplier.
Age Requirements: Minimum ages vary by cruise line, resort, tour operator, destination, and activity. Some tours may have a minimum age of 6 months, while certain South Africa, Dubai, and European tour programs may require children to be at least 12 years old. Cruise lines may also have specific minimum-age and adult-in-cabin requirements. It is the traveler’s responsibility to meet the age requirements of the supplier booked for their trip.
Child discounts may be available with certain suppliers and room arrangements but are not guaranteed.
Parents and accompanying adults are responsible for the safety and supervision of children traveling with them, including providing any required child safety equipment, such as car or booster seats.
Traveling Without Both Parents: A minor traveling with only one parent, without either parent, or with another adult may be required to carry additional documentation, including a notarized consent letter from the non-traveling parent(s) or legal guardian(s). Requirements vary by destination and supplier, so travelers are responsible for confirming and carrying all required documentation.
RISKS, SAFETY & TRAVEL ADVISORIES
Certain destinations and travel activities may involve greater risks than others. Conditions can change before or during travel due to weather, natural disasters, illness or public health concerns, crime, political or civil unrest, transportation disruptions, government restrictions, or other circumstances beyond the control of Branch Out Travel Group LLC.
Travelers are responsible for staying informed about current travel advisories, warnings, health information, restrictions, and safety conditions for their destination before booking and throughout travel.
Branch Out Travel Group LLC encourages travelers to review current information from the U.S. Department of State, Centers for Disease Control and Prevention (CDC), and other applicable government authorities.
Smart Traveler Enrollment Program (STEP): U.S. citizens traveling internationally may consider enrolling in STEP, a free U.S. Department of State service that can help travelers receive important information and assist the government in contacting them during an emergency. https://step.state.gov
By choosing to travel, you acknowledge and accept the risks associated with your destination and travel activities.
Branch Out Travel Group LLC does not represent or guarantee that any destination is advisable, safe, or without risk and is not responsible for losses, delays, cancellations, injuries, expenses, or other damages resulting from circumstances beyond our reasonable control.

Requirements may change at any time. Travelers are responsible for verifying the requirements applicable to their individual trip.
DEPOSITS, PAYMENTS & FINAL PAYMENT
A reservation is not confirmed until the required deposit or payment has been received and confirmation has been issued.
Deposit amounts, payment schedules, refundability, and cancellation penalties vary by travel supplier and reservation. All payments are subject to the terms and conditions of the applicable cruise line, resort, hotel, tour operator, airline, or other travel supplier.
Payment Deadlines: Travelers are responsible for making all payments by the due dates shown on their invoice or payment schedule. Failure to make a required payment on time may result in cancellation of the reservation and loss of payments already made, according to the supplier’s terms and conditions.
Final Payment: Final payment must be received no later than the final payment date shown on your invoice. Travelers are responsible for keeping track of payment due dates and should not rely solely on payment reminders from Branch Out Travel Group LLC.
If you are unable to make a payment by the required due date, please contact Branch Out Travel Group LLC before the payment is due. An extension cannot be guaranteed and is subject to supplier policies, approval, and availability.
Late Payments & Fees: Payments not received by the due date may be subject to a $50 late fee from Branch Out Travel Group LLC.
Any additional late fees, penalties, price increases, reinstatement fees, or other charges imposed by the travel supplier are the traveler’s responsibility and will be charged in addition to any Branch Out Travel Group LLC late fee.
Payment of a late fee does not guarantee that a reservation can be reinstated or maintained. Reservations remain subject to the supplier’s payment deadlines, availability, and cancellation policies.
Branch Out Travel Group LLC is not responsible for a reservation that is canceled due to missed or late payments, declined payment methods, or failure to meet a supplier’s payment deadline.
CHANGES TO CONFIRMED RESERVATIONS
Once a reservation has been confirmed, any requested changes are subject to current pricing, availability, supplier policies, and restrictions at the time the change is made.
Changes may include, but are not limited to, travel dates, accommodations, room or cabin categories, passenger information, or other components of the confirmed reservation.
Branch Out Travel Group LLC may charge a $100 change fee per reservation/change request, in addition to any fees, penalties, or price increases charged by the travel supplier.
Some changes may not be permitted by the supplier and may require cancellation and rebooking. In these cases, the supplier’s cancellation policies, current pricing, and availability will apply.
This policy applies to changes made after a reservation has been confirmed and is separate from the 3 proposal revisions included with Concierge Care.
CANCELLATIONS
All cancellation requests must be submitted in writing to Cancellation@branchouttravel.com and must include the traveler’s full name, invoice number, and travel date. Cancellation requests sent by text message, social media, the travel app, or to another email address will not be considered an official cancellation request.
Cancellation fees, penalties, refunds, and credits are determined by the terms and conditions of the applicable travel supplier. Some deposits, payments, fees, and reservations may be partially or completely nonrefundable and/or nontransferable.
Branch Out Travel Group LLC fees, including the Concierge Care Fee and any applicable administrative, late, or change fees, are nonrefundable.
Transfers to Another Travel Agency: Branch Out Travel Group LLC does not transfer confirmed reservations to another travel agency. If you choose to discontinue services with Branch Out Travel Group LLC, your reservation will be canceled subject to all applicable supplier cancellation policies, fees, and penalties. You may then make new travel arrangements independently or with another travel agency.
No-Shows: Failure to travel as scheduled is considered a cancellation and is subject to the applicable supplier’s cancellation policies.
Cancellation requests will be processed during normal business days. Submission of a cancellation request does not automatically stop or reverse supplier penalties. The effective cancellation date will be determined according to the applicable supplier’s policies and when the cancellation can be processed.
Travel protection is strongly recommended because cancellation penalties and other losses may apply when travel plans change.
CHARGEBACKS & PAYMENT DISPUTES
By submitting payment, you acknowledge that you have authorized the transaction and agree to the applicable payment, cancellation, and refund policies of Branch Out Travel Group LLC and the travel suppliers associated with your reservation.
A chargeback or payment dispute should not be used as a substitute for the cancellation or refund procedures outlined in these Terms & Conditions or the applicable supplier’s terms.
If you believe a charge was made incorrectly, please contact Branch Out Travel Group LLC promptly so the matter can be reviewed.
If an authorized payment is disputed or reversed, Branch Out Travel Group LLC reserves the right to provide the financial institution with documentation related to the transaction, including payment authorizations, invoices, communications, these Terms & Conditions, supplier policies, and reservation records.
To the extent permitted by law, the traveler may be responsible for reasonable fees or costs incurred by Branch Out Travel Group LLC as a result of an improper chargeback or payment reversal.
TRAVEL PROTECTION
Branch Out Travel Group LLC strongly recommends travel protection for all travelers. Travel protection may help protect your financial investment and provide benefits for certain unexpected circumstances, subject to the specific terms, conditions, limitations, and exclusions of the policy purchased.
Travel protection is optional unless otherwise required for a particular trip or supplier.
Branch Out Travel Group LLC may provide access to a travel protection plan for your review. Travelers are responsible for reviewing the policy, coverage, benefits, exclusions, limitations, and any optional or additional coverage available before making a decision.
Additional Coverage Options: Travelers should carefully review any available add-on or optional coverage and determine whether additional protection is appropriate for their individual needs.
Branch Out Travel Group LLC does not determine whether a particular policy or level of coverage is appropriate for you and does not guarantee that a claim will be covered or approved.
Insurance Questions: Questions regarding coverage, benefits, exclusions, pre-existing conditions, Cancel For Any Reason coverage, claims, or whether a particular situation is covered must be directed to the licensed travel insurance provider.
Coverage options and purchase deadlines vary by policy. Some benefits or optional coverages may only be available when insurance is purchased within a specified period after the initial trip deposit or payment. Travelers are responsible for reviewing and meeting all applicable deadlines.
Declining Travel Protection: If you choose not to purchase travel protection, you accept responsibility for any cancellation penalties, nonrefundable payments, medical expenses, travel disruptions, or other out-of-pocket expenses that may result.
Claims: All claims and requests for benefits must be submitted directly to the travel insurance provider. Branch Out Travel Group LLC does not make coverage decisions, process or approve claims, or control the insurance provider’s determination of benefits.
Travelers who purchase travel protection are responsible for reviewing their policy documents upon receipt and promptly contacting the insurance provider if any information appears incorrect.
BAGGAGE & AIRLINE FEES
Airline baggage, seat selection, priority boarding, and other optional airline fees are not included in your travel package unless specifically stated otherwise.
Each airline establishes its own baggage allowances, size and weight restrictions, and fees. These policies and fees may change at any time.
Travelers are responsible for reviewing their airline’s current baggage policies before departure and for paying any applicable baggage, overweight, oversized luggage, seat selection, or other airline-imposed fees.
Branch Out Travel Group LLC is not responsible for additional costs resulting from airline baggage or seating policies.

HONEYMOON & ANNIVERSARY TRAVELERS
If you are traveling for a honeymoon or anniversary, please notify Branch Out Travel Group LLC so the occasion can be noted on your reservation when applicable.
Some resorts and travel suppliers may offer complimentary honeymoon or anniversary amenities or packages. These benefits are not guaranteed and may require proof of marriage, such as a marriage certificate, and may only be available for travel within a specific timeframe of the wedding or anniversary date.
Travelers are responsible for meeting the supplier’s eligibility and documentation requirements for any honeymoon or anniversary benefits.
AIRFARE
Airline Tickets & Reservations
Airline tickets are subject to the individual airline’s terms, conditions, fare rules, and restrictions. Tickets may be nonrefundable, nontransferable, and subject to change or cancellation fees.
Changes to passenger names, travel dates, flight times, routes, or departure/arrival airports are subject to airline approval and may result in additional costs. Travelers are responsible for all applicable airline fees and fare differences.
Unless otherwise requested and confirmed, airfare booked by Branch Out Travel Group LLC will generally be booked in economy class.
Seat assignments, upgrades, frequent flyer benefits, and other airline services are controlled by the airline and cannot be guaranteed by Branch Out Travel Group LLC.
Flight Schedules & Check-In
Airlines may change flight schedules, aircraft, routes, seat assignments, or other flight details after booking. Travelers are responsible for monitoring their flights and checking directly with the airline for current flight information, particularly within 24 hours of departure.
Travelers are responsible for arriving at the airport with sufficient time to complete airline check-in, baggage drop, security screening, and boarding. Failure to check in or arrive at the gate on time may result in denied boarding or loss of the ticket.
Flight Delays, Cancellations & Changes
If an airline delays, cancels, or significantly changes a flight, the traveler should work directly with the airline or airport/gate personnel first. Airline personnel have direct access to flight operations, rebooking options, and available alternatives and are generally able to provide the fastest assistance.
Branch Out Travel Group LLC may assist when reasonably possible but cannot control airline operations, availability, or the options offered by the airline.
Travelers are responsible for any additional costs resulting from airline delays, cancellations, schedule changes, missed connections, rebooking, accommodations, meals, transportation, or other expenses unless those costs are covered or reimbursed by the airline, travel supplier, or travel protection policy.
Branch Out Travel Group LLC is not responsible for missed portions of a trip resulting from airline delays, cancellations, missed connections, schedule changes, weather, mechanical issues, security delays, or other circumstances outside our control.
Connecting Flights & Airports
Travelers are responsible for allowing sufficient time between connecting flights. When an itinerary requires travel between different airports, the traveler is responsible for arranging and paying for transportation between those airports and allowing adequate transfer time.
Branch Out Travel Group LLC is not responsible for missed flights or additional expenses resulting from insufficient connection or airport-transfer time.
Lost, Delayed or Damaged Baggage
Lost, delayed, stolen, or damaged baggage must be reported directly to the airline before leaving the airport whenever possible. Travelers are responsible for following the airline’s procedures for filing baggage claims and retaining any required documentation or receipts.
Branch Out Travel Group LLC does not control baggage handling or airline baggage claims and is not responsible for lost, delayed, stolen, or damaged baggage.
PROHIBITED AIRLINE TICKETING PRACTICES
Travelers must use airline tickets in accordance with the airline’s fare rules and conditions of carriage. Practices prohibited by an airline, including hidden-city ticketing, throwaway ticketing, or back-to-back ticketing, may result in cancellation of flights, additional charges, loss of frequent flyer benefits, or other action by the airline.
Branch Out Travel Group LLC is not responsible for consequences resulting from a traveler’s misuse of an airline ticket or violation of an airline’s rules.
ACCOMMODATIONS & ACTIVITIES
Accommodations
Hotels and resorts are independent travel suppliers and establish their own policies, services, amenities, room classifications, check-in/check-out times, and standards.
Hotel ratings and descriptions are provided for general guidance and may vary by country, supplier, or rating system. Branch Out Travel Group LLC does not independently inspect or guarantee the condition, quality, amenities, or rating of any accommodation.
Room Types & Requests: Room categories are based on the supplier’s description. Requests for specific bedding, adjoining or connecting rooms, locations, views, floors, or other preferences are requests only unless specifically confirmed and guaranteed by the supplier.
Travelers are responsible for any incidental charges, resort fees, deposits, parking fees, or other charges not specifically listed as included in their travel package.
Check-In & Check-Out
Check-in and check-out times vary by property. Early check-in and late check-out are subject to availability and may require an additional fee.
Travelers arriving before their room is available or departing after check-out should be prepared to have the property store their luggage when that service is available.
Meals & Dietary Requests
Meals are included only when specifically stated in the travel package or itinerary.
Special dietary requests, allergies, or food preferences should be communicated in advance when possible. Branch Out Travel Group LLC may forward these requests to the supplier but cannot guarantee that a hotel, resort, cruise line, restaurant, tour operator, or other supplier will be able to accommodate them.
Activities, Tours & Excursions
Activities, tours, excursions, attractions, and other experiences are operated by independent suppliers and may have their own age, height, weight, health, mobility, clothing, equipment, or participation requirements.
Travelers are responsible for reviewing and meeting all requirements before participating.
Activities may be changed, delayed, or canceled due to weather, safety concerns, operational issues, availability, or other circumstances outside the control of Branch Out Travel Group LLC.
CRUISE EXCURSIONS & RETURN TO SHIP
When booking excursions independently or through Branch Out Travel Group LLC, travelers are responsible for allowing enough time to return to the ship before the required all-aboard time.
We strongly recommend planning to return to the ship area at least 2-3 hours before the required all-aboard time, particularly when using an independent excursion provider.
Branch Out Travel Group LLC is not responsible for ensuring travelers return to the ship on time or for missed sailings, transportation, accommodations, rebooking costs, or other expenses resulting from a traveler returning late.
Travelers should carefully review excursion times, transportation arrangements, distance from the port, and the ship’s required return time before booking.
Pregnancy, Medical Conditions & Special Needs
Travelers are responsible for determining whether they are physically and medically able to participate in their selected travel arrangements and activities.
Pregnant travelers and travelers with medical conditions, mobility limitations, disabilities, or other special needs should review applicable supplier requirements before booking and traveling.
Branch Out Travel Group LLC should be notified of requested accommodations or special needs as early as possible so requests can be communicated to the appropriate supplier. Requests cannot be guaranteed and remain subject to the supplier’s availability and ability to accommodate them.
Some suppliers, destinations, transportation providers, tours, or activities may have limitations or restrictions related to pregnancy, mobility, medical conditions, or accessibility. Travelers are responsible for confirming that their selected travel arrangements are appropriate for their individual needs.
HEALTH & PUBLIC HEALTH REQUIREMENTS
Travel may involve exposure to illness, communicable diseases, and other public health risks. Travelers voluntarily assume the health risks associated with travel.
Destinations, governments, airlines, cruise lines, resorts, tour operators, and other travel suppliers may establish or change health-related requirements before or during travel. These may include testing, vaccination, health documentation, screenings, quarantine, masking, or other requirements.
Travelers are responsible for reviewing and complying with all health and public health requirements applicable to their trip.
Branch Out Travel Group LLC is not responsible for denied boarding or entry, quarantine, trip interruption, cancellation, additional expenses, or other losses resulting from illness, exposure to illness, or failure to meet applicable health requirements.
Health requirements and travel conditions may change at any time, including after a reservation has been confirmed.
ITINERARY & SUPPLIER CHANGES
Travel itineraries, accommodations, transportation, activities, excursions, and other services may be changed, substituted, delayed, or canceled by a travel supplier when necessary.
Changes may occur due to weather, safety concerns, government actions, strikes, transportation disruptions, supplier availability, operational issues, or other circumstances beyond the control of Branch Out Travel Group LLC.
When possible, the travel supplier may provide a comparable alternative or substitute service. Any refunds, credits, substitutions, or compensation resulting from a supplier change will be determined by the applicable supplier’s policies.
Branch Out Travel Group LLC will make reasonable efforts to communicate known changes and assist travelers when appropriate but cannot guarantee that the original itinerary, accommodation, activity, transportation, or other travel service will remain unchanged.
Branch Out Travel Group LLC is not responsible for additional costs, losses, or damages resulting from changes made by travel suppliers or circumstances beyond our reasonable control.
TRAVELER RESPONSIBILITIES
Travelers are responsible for reviewing all information provided by Branch Out Travel Group LLC and applicable travel suppliers, including invoices, itineraries, travel documents, emails, app notifications, payment deadlines, and trip updates.
Travelers are responsible for arriving on time for flights, cruises, tours, transfers, excursions, and other scheduled travel services and for following all instructions, rules, laws, and requirements of the applicable supplier, destination, and government authorities.
Travelers are expected to conduct themselves appropriately and respectfully while traveling. Suppliers may refuse service, remove a traveler, or terminate participation when behavior is disruptive, unsafe, unlawful, or violates supplier policies.
Any costs, damages, penalties, missed services, or additional expenses resulting from a traveler’s actions, failure to follow instructions, failure to review provided information, or failure to arrive on time are the traveler’s responsibility.
Travelers are responsible for any damage they cause to accommodations, transportation, property, or equipment during their trip.
AGENT / INTERMEDIARY
Branch Out Travel Group LLC acts as an independent travel advisor and intermediary between travelers and independent travel suppliers, including airlines, cruise lines, hotels, resorts, tour operators, transportation providers, excursion companies, and other suppliers providing travel-related services.
Branch Out Travel Group LLC does not own, operate, manage, or control these independent suppliers and is not responsible for their acts, omissions, errors, representations, warranties, breaches, negligence, cancellations, delays, schedule changes, service failures, or other actions.
Each supplier is responsible for providing the services it has agreed to provide and operates under its own terms, conditions, policies, and limitations of liability.
LIMITATION OF LIABILITY
To the extent permitted by applicable law, Branch Out Travel Group LLC shall not be liable for injury, loss, damage, delay, inconvenience, additional expense, or other claims resulting from the acts or omissions of independent travel suppliers or circumstances beyond the reasonable control of Branch Out Travel Group LLC.
This includes, but is not limited to, supplier cancellations or failures, transportation delays, missed connections, lost or damaged baggage, weather events, natural disasters, government actions, labor disputes, illness, public health events, civil unrest, or other events outside our control.
Branch Out Travel Group LLC is responsible only for the travel advisory and reservation services it directly provides and does not guarantee the performance, quality, safety, or availability of services provided by independent travel suppliers.
FORCE MAJEURE
Branch Out Travel Group LLC is not responsible for delays, cancellations, changes, losses, damages, additional expenses, or failure to provide travel services when caused by circumstances beyond our reasonable control.
These circumstances may include, but are not limited to, severe weather, hurricanes, floods, fires, earthquakes, natural disasters, epidemics or pandemics, public health emergencies, war, terrorism, civil unrest, government actions or restrictions, labor strikes, transportation disruptions, airline or supplier operational issues, power or technology failures, or other unforeseen events.
When a force majeure event affects travel, refunds, credits, rebooking options, or other remedies will be determined by the policies of the applicable travel supplier.
Travelers are responsible for any additional expenses not covered or reimbursed by the applicable supplier or travel protection policy.
Branch Out Travel Group LLC will make reasonable efforts to assist travelers with available options but cannot guarantee refunds, credits, replacement travel arrangements, or specific outcomes when circumstances are outside our control.
CLAIMS & NOTICE OF COMPLAINTS
Any claim, complaint, or dispute relating to services provided by Branch Out Travel Group LLC must be submitted in writing within 30 days following the completion of travel. The written notice should include the traveler’s name, reservation information, details of the claim or complaint, and any supporting documentation.
Failure to provide written notice within the required timeframe may affect the traveler’s ability to pursue the claim to the extent permitted by applicable law.
TIME LIMIT FOR LEGAL ACTION
To the extent permitted by applicable law, any lawsuit, arbitration, or other legal proceeding arising from or relating to the traveler’s reservation, travel arrangements, or services provided by Branch Out Travel Group LLC must be commenced within one (1) year of the incident giving rise to the claim.
GOVERNING LAW & VENUE
These Terms & Conditions and any dispute arising from or relating to the services provided by Branch Out Travel Group LLC shall be governed by the laws of the State of Mississippi, without regard to conflict-of-law principles.
To the extent a dispute is permitted or required to be heard in court, the parties agree that the action shall be brought exclusively in the appropriate state or federal court located in or serving Tupelo, Mississippi, to the extent permitted by applicable law.
DISPUTE RESOLUTION & ARBITRATION
Before initiating formal legal proceedings, the traveler and Branch Out Travel Group LLC agree to make a reasonable good-faith effort to resolve the dispute directly.
Except for matters that may legally be brought in small claims court or where arbitration is prohibited by law, disputes arising from or relating to these Terms & Conditions, a reservation, or services provided by Branch Out Travel Group LLC shall be resolved through binding arbitration rather than a jury trial or court proceeding.
Arbitration shall take place in Tupelo, Mississippi, unless otherwise required by applicable law.
To the extent permitted by law, disputes must be brought on an individual basis only and not as part of a class, collective, consolidated, or representative action.
ATTORNEY’S FEES & COSTS
To the extent permitted by applicable law, if Branch Out Travel Group LLC is required to take legal action, arbitration, or collection action to enforce these Terms & Conditions or collect amounts lawfully owed, the traveler shall be responsible for reasonable attorney’s fees, arbitration fees, court costs, collection costs, and other reasonable expenses incurred by Branch Out Travel Group LLC, where permitted by law.
SEVERABILITY
If any provision of these Terms & Conditions is determined to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect to the extent permitted by law.
ELECTRONIC COMMUNICATIONS & TRAVEL APP
Branch Out Travel Group LLC may communicate with travelers and provide trip-related information electronically through email, text message, and/or our travel app.
Travel information may include itineraries, travel documents, confirmations, payment reminders, flight information, schedule changes, destination information, activities, and other important trip updates.
Travelers are responsible for providing accurate contact information, maintaining access to their email and travel app, and reviewing all information and updates provided before and during travel.
Travelers should notify Branch Out Travel Group LLC if their email address, telephone number, or other contact information changes.
Failure to open, read, or review information that has been provided does not relieve the traveler of responsibility for complying with deadlines, instructions, supplier requirements, or other important trip information.
Flight information provided through the travel app is for convenience. Travelers remain responsible for confirming current flight times, gates, delays, cancellations, and other operational information directly with the airline.
Branch Out Travel Group LLC is not responsible for missed communications resulting from incorrect contact information, spam or junk-mail filtering, disabled notifications, device issues, internet or cellular service interruptions, or a traveler’s failure to review provided information.
SUPPLIER TERMS & CONDITIONS
Travel services arranged by Branch Out Travel Group LLC are provided by independent suppliers, including airlines, cruise lines, hotels, resorts, tour operators, transportation companies, excursion providers, and other travel-related businesses.
In addition to these Terms & Conditions, travelers are subject to the terms, conditions, policies, rules, and restrictions of each applicable travel supplier.
Supplier terms may include additional requirements regarding payments, cancellations, refunds, changes, identification, age restrictions, baggage, conduct, health requirements, check-in, and other conditions of travel.
Travelers are responsible for reviewing and complying with applicable supplier terms and requirements.
If a supplier’s policy regarding its own travel service differs from a Branch Out Travel Group LLC policy, the supplier’s terms will govern that supplier’s service.
Branch Out Travel Group LLC cannot waive, modify, or override a supplier’s terms, policies, penalties, or requirements unless the supplier expressly authorizes the change.
PHOTOS, VIDEOS & MARKETING
During Branch Out Travel Group LLC hosted trips, group events, or activities, photographs and videos may be taken by Branch Out Travel Group LLC, its representatives, or other participants.
Unless you notify Branch Out Travel Group LLC in writing that you do not wish to be photographed or recorded, you grant Branch Out Travel Group LLC permission to use photographs or video containing your image or likeness for legitimate business and promotional purposes, including our website, social media, advertisements, and other marketing materials.
No compensation will be provided for the use of such photographs or videos.
Travelers who do not wish to appear in Branch Out Travel Group LLC marketing materials should notify us in writing before travel. We will make reasonable efforts to honor the request.
CHANGES TO TERMS & CONDITIONS
Branch Out Travel Group LLC reserves the right to update or modify these Terms & Conditions when necessary due to changes in business practices, supplier requirements, laws, regulations, or other circumstances.
The Terms & Conditions in effect at the time of booking will generally apply to the traveler’s reservation unless a change is required by law, government regulation, or an applicable travel supplier.
ENTIRE AGREEMENT
These Terms & Conditions, together with the traveler’s invoice, proposal, itinerary, applicable supplier terms and conditions, and any other written agreements specific to the reservation, constitute the agreement between the traveler and Branch Out Travel Group LLC regarding the travel services provided.
If any provision of these Terms & Conditions conflicts with a specific written agreement issued by Branch Out Travel Group LLC for a particular reservation, the terms of the specific written agreement will control for that reservation.
ACKNOWLEDGMENT & ACCEPTANCE
By accepting these Terms & Conditions, submitting payment, authorizing a reservation, or otherwise proceeding with travel services through Branch Out Travel Group LLC, the traveler acknowledges that they have had the opportunity to review these Terms & Conditions and agrees to be bound by them.
The traveler making the reservation is responsible for sharing applicable travel information, requirements, supplier policies, and these Terms & Conditions with all travelers included in the reservation.
